Amendment No.2 Bill by Parliament of Zimbabwe;Youth Queried the Process #YouthCivicSpaceZw


National Association of Youth Organizations Statement on the Public Hearings for the Portfolio Committee on Justice, Legal and Parliamentary Affairs for the Constitution of Zimbabwe Amendment No.2 Bill (H.B. 23, 2019), HARARE, 10 June 2020

The National Association of Youth Organizations (NAYO Africa) is a Youth Umbrella Body for youth organizations working in Zimbabwe. Its vision is to see a repositioned, redefined and enhanced role of youth in community and national, regional and international developmental processes.

RECALLING the Parliaments role to ‘protect the Constitution and promote democratic governance in Zimbabwe’ and the powers of Parliament to ensure that ‘provisions of the Constitution are upheld by the State and all institutions and agencies of Government at every level and act constitutionally and in the national interest’;

BEARING IN MIND the rights of the youth ‘to have opportunities to associate and to be represented and participate in political, social, economic and other spheres of life’ and every Zimbabwean citizens right ‘to participate, individually or collectively, in gatherings or groups or in any manner, in peaceful activities to influence, challenge or support the policies of the Government or any political or whatever cause’;

NOTING WITH CONCERN the publication of the Consultation dates for the Constitution of Zimbabwe Amendment No.2 Bill (H.B. 23, 2019) and the timing thereof to hold the Public hearings when the country is under an indefinite National Lockdown to curb the spread of COVID-19 with serious restrictions on the exercise of freedoms to association, assembly and the movement by citizens currently in place;

PERTURBED by the long term adverse implications thereof of the proposed amendments to foundational values and principles of the Constitution, transparency, good governance, accountability, fiscal probity, principles of good administration and separation of powers in Zimbabwe;

REAFFIRMING the Government’s commitment to act in the ‘National interest’ we thus make an urgent plea for:
·         The Parliament to postpone the holding of the Public Hearings on the Constitution of Zimbabwe Amendment No.2 Bill (H.B. 23, 2019) until the lifting of the National Lockdown imposed to control the spread of COVID-19. The magnitude of the proposed amendments require for citizens to fully exercise their rights to association, assembly and expression in formations of their choice to enable informed and proactive citizen participation;  
·         The Parliament to consider central venues for holding the public consultations accessible to the majority of citizens including for persons with Disabilities (PWDs), youth and women within each respective province to ease participation by interested citizens. The current list of selected venues disenfranchises citizens within urban centers especially – there is thus a need to ensure the inclusive participation of all interested citizens;
·         The Government of Zimbabwe to focus on enhancing efforts to suppress community transmission given the rise in local transmissions through context-appropriate infection prevention and control measures and towards Economic Recovery by creating Post COVID-19 Pathways for return to normalcy as opposed to Constitutional Reforms which have no urgency to the immediate livelihoods, welfare and posterity of Zimbabweans;
·         The Parliament of Zimbabwe to act in the National interest of citizens and respect the dictates within the Constitution that provide for the participation of citizens especially section 67 which provides for rights of citizens ‘to participate, individually or collectively, in gatherings or groups or in any manner, in peaceful activities to influence, challenge or support the policies of the Government or any political or whatever cause’ – proceeding with the Public Hearings infringes civic and political rights of citizens;
·         The Parliament of Zimbabwe to suspend all Parliamentary processes that require Parliament to go in public places in conforming to the measures set by the Government under the National Lockdown.
·         The Parliament of Zimbabwe to recognize the role played by Civil Society Organizations as interlocutors between the State and Citizens and its complimentary roles to Government towards addressing inequalities, ensuring citizen participation and the protection of rights;

We remain committed in this unprecedented moment to work with youth progressively in defending the dictates of the Constitution and in complimenting the efforts of the Government where possible in the fight against COVID 19.

We also remain focused on the No to Amendments before Constitutional Implementation; as the proposed amendments are a threat to the Doctrine of Separation of Powers.

We urge the Government even in this unprecedented moment to act in the National interest.  The country is faced with urgent issues that require for all of us to work together to curb the COVID-19 pandemic; ensure human dignity and posterity and the other core issue being the implementation of the Constitution not amendment.

Statement on the Launch of the: Youth Pushing Back Campaign #YouthCivicSpaceZW #LeaveNoYouthBehind


National Association of Youth Organizations (NAYO): Statement on the Launch of the: Youth Pushing Back Campaign #YouthCivicSpaceZW, HARARE, Zimbabwe, 09 June 2020

The National Association of Youth Organizations (NAYO) is a youth umbrella body for youth organizations working in Zimbabwe, the National Youth Sector Chair for NANGO, a member of Zimbabwe Human Rights Commission (ZHRC), Special Interest Groups representing youth and member of Civicus. Its work seeks to redress the challenges that youth are facing and contribute towards their active participation in developmental processes through: Coordination, Advocacy, Mobilization, Capacity Building and Information Sharing Initiatives through the Youth Development Model (YDM).

Today, NAYO in partnership with CIVICUS officially launches the Youth Pushing Back Campaign #YouthCivicSpaceZW which seeks to defend the freedoms to association and assembly which are guaranteed for all by the Constitution of Zimbabwe in Chapter 4 - Bill of Rights.

The Youth Pushing Back Campaign which is coordinated under #LeaveNoYouthBehind is designed at the backdrop of a National Outreach that NAYO undertook in October 2019 that established key issues pertaining to how youth actors are organizing at the community level, coordinating their civic efforts and structuring their interventions in the wake of the crackdown on civil society organizations by the Government.

Youth across the provinces highlighted the lack of freedoms to assembly, association and expression concurring with the End of Mission Statement to Zimbabwe, of the United Nations Special Rapporteur on the Rights to Freedom of Peaceful Assembly and of Association, Mr. Clément Nyaletsossi Voule. Furthermore, youth noted increasing intimidation, threats, ban to activities, unlawful arrests and continued targeting of youth by the Government agencies, which militates against the constitution.

The campaign therefore seeks to engage authorities, bring to attention issues around youth exercise of the freedoms to association and assembly, to protect youth agency which are critical to the realization of broader rights and social change in Zimbabwe.

CSO Round Table on Validation of the Zimbabwe Youth Council Draft Shadow Bill

The National Association of Youth Organizations (NAYO) leading the Youth Working Group on Civic Space held the CSOs Round table on the validation of the Draft Zimbabwe Youth Council (ZYC) Act Shadow Bill on the 19th of March 2019. The National Association of Youth Organizations Programs Manager Mr MacDonald Munyoro chronicled the journey that had been walked and the process that had resulted in the draft Zimbabwe Youth Council Act Shadow Bill that was to be tabled by the Consultant. It was also noted that the objective of the meeting was to ensure the youth subject the draft Shadow Bill, to interrogate it and make all necessary inputs on it as this constituted the validation process.

The Legal Expert, Mr Masendo took the opportunity to present to the youth meeting participants the draft ZYC Shadow Bill. He noted that this draft Bill waited inputs from the youth as it was not yet in its final stage but still a draft. He highlighted the key areas that were revised in the current Zimbabwe Youth Council (ZYC) Act around Youth Associations Membership, the mandatory nature of the Act towards registration of youth Associations, the discipline of registered youth associations concerning de-registration of youth associations with the Council. Mr Masendo also noted that as the consultants their role was to also subject the current Zimbabwe Youth Council (ZYC) Act to other frameworks in the Region and to incorporate other progressive youth provisions in the draft Zimbabwe Youth Council (ZYC) Shadow Bill for instance provisions of a National Youth Fund as well as relaxed provisions on the registrations of youth associations.

NAYO appalled by shrinking civic space

The National Association of Youth Organisations (NAYO) has said it is perturbed by the continued crackdown on Civil Society Organisations (CSOs); Non-Governmental Organisations (NGOs), Journalists,  activists and human rights defenders; most of whom are youth. 

“The crackdown has seen unlawful suspension of NGOs as in the case of COTRAD in Masvingo; targeting of NGO leaders as seen by the arrests; increasing political rhetoric to tighten provisions for demonstrations with a corresponding increase of protests being banned by the police (last week youth had their solidarity march on shrinking civic space banned by the Police); continued brutality of the police as seen by the recent attack on journalists covering clashes between vendors and City Council Police; Public downplaying of the role of NGOs labelling them as ‘regime change agents’, the disproportionate targeting of youth; and the continued shrinking civic space for NGOs to operate in communities, ” said MacDonald Munyoro, the NAYO Programmes Manager.

NAYO Petition On Civic Space In Zimbabwe

The National Association of Youth Organizations (NAYO) having been perturbed by the continued crackdown on Civil Society Organizations (CSOs), Non-Governmental Organizations (NGOs), Journalists,  activists and human rights defenders, most of whom are youth.  This has been also characterized by unlawful suspension of NGOs as in the case of COTRAD in Masvingo, targeting of NGOs as in the arrests, calls to tighten provisions for demonstrations, public downplaying of NGOs and the continued shrinking civic space for NGOs and citizens. 

NOW THEREFORE, your petitioners beseech the Parliament of Zimbabwe to exercise its constitutional role and address the following issues of public concern:



SHADOW BILL- ZIMBABWE YOUTH ACT


The Shadow Bill of the Zimbabwe Youth Act being an 'ACT to establish a legal framework to achieve the aspirations of the youths as provided for in the Constitution, to provide for the establishment of the Zimbabwe Youth Council and to provide for the functions thereof; to provide for the registration and regulation of clubs and national associations; to establish the Youth Fund and its management, to provide for National Colors for youth; to repeal the Zimbabwe Youth Council Act and to provide for matters incidental to or connected with the foregoing.'

NAYO SHRINKING CIVIC SPACE IN ZIMBABWE- PRESS STATEMENT


The National Association of Youth Organizations (NAYO Africa) a Youth Umbrella Body for youth organizations working in Zimbabwe with the vision to see a re positioned, redefined and enhanced role of youth in community and national, regional and international developmental processes. The work of NAYO Africa seeks to redress the challenges that youth are facing and contribute towards their active participation in developmental processes through Coordination, Advocacy, Mobilization, Capacity Building and information Sharing initiatives. The agency of youth remains cardinal in achieving this hence on the 16th April 2019, NAYO Africa held a Press Conference on the shrinking Civic Space in Zimbabwe with the call on the Zimbabwe Government to enact legislative frameworks that allow for the full realization of the Freedoms of Association, Assembly and Expression which make up the key pillars of Civic Space.
